Eros Psychiatry & Sex Therapy (“EPST,” “we,” “our,” or “us”) is committed to protecting your privacy in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA), the California Online Privacy Protection Act (CalOPPA), the Texas Data Privacy and Security Act (TDPSA), and all other applicable privacy laws in Arizona, California, and Texas.

This Notice applies to both your Protected Health Information (PHI) and other personal data collected through our website and online systems.

1. Scope and Definitions

Protected Health Information (PHI): Individually identifiable health information created or received by EPST during the course of your treatment.

Consultation Forms: Google Forms (HIPAA-compliant; BAA in place)

Scheduling (non-PHI): Acuity Scheduling

Payment Processing: Stripe (via SimplePractice, secure encryption)

Do not send PHI via standard email or web forms; use the SimplePractice Client Portal for secure communications.

3. HIPAA Uses and Disclosures

We may use or disclose PHI for the following purposes:

Treatment: Providing, coordinating, or managing your health care, including consultation with other providers and referral coordination.

Payment: Billing, payment collection, insurance verification, and reimbursement-related activities.

Health Care Operations: Quality improvement, staff training, auditing, compliance, case management, and business administration.

Other Permitted Disclosures
We may disclose PHI for legal, law enforcement, public health, or safety reasons, or as otherwise required by law.
We may create de-identified health information by removing identifying details.

All other uses or disclosures require your written authorization, which you may revoke at any time in writing.

4. Patient Rights Under HIPAA

You have the right to:

  • Request restrictions on certain uses or disclosures (though we are not always required to agree).

  • Receive confidential communications by alternative means or locations.

  • Inspect and obtain copies of your PHI.

  • Request amendments to your PHI, with written response within 60 days.

  • Receive an accounting of disclosures.

  • Be notified in the event of a breach of unsecured PHI.

  • Request that information related to self-paid services not be shared with your health plan.

  • Obtain a paper copy of this Notice at any time.

We will not retaliate against you for filing a privacy complaint.

5. Information Collected Through the Website

We collect the following categories of personal information when you visit our website or use our services:

9. State Privacy Rights

California Residents (CCPA/CPRA)

We may collect the following categories of personal information: identifiers, commercial data, internet activity, and inferences.

We do not collect or sell sensitive personal information for the purpose of inferring characteristics.

California residents have the right to:

  • Know what personal data we collect and how we use it.

  • Request access to or deletion of your data.

  • Request correction of inaccurate information.

  • Opt out of sale or sharing of data (we do not sell or share).

  • Not be discriminated against for exercising these rights.

CalOPPA

Our website displays a clear Privacy Notice and discloses data categories collected and shared.

We do not respond to browser “Do Not Track” signals, but users can control cookies via browser settings.

Texas Residents (TDPSA)

Texas residents may request access, correction, deletion, or a portable copy of their data and opt out of targeted advertising.

We do not sell or use data for such purposes.

Arizona Residents

Arizona does not yet have a comprehensive privacy statute. We voluntarily honor privacy-related requests consistent with this Notice.

10. International Transfers

Information may be processed on servers located in the United States or other jurisdictions.

By using our services, you consent to such transfers as permitted by applicable law.

11. Sale or Transfer of Business

In the event of a merger, acquisition, or sale, your data may be transferred to a successor entity that agrees to the same privacy protections.

Our services are directed to adults aged 18 and over. We do not knowingly collect personal data from minors under 13. If such data is discovered, we will delete it promptly.

EPST provides telehealth and therapy services only to individuals physically located in Arizona, California, or Texas at the time of service.

No Guarantee of Services
Submitting a contact form or scheduling a consultation does not establish a clinical relationship. EPST reserves the right to determine service appropriateness.

Intellectual Property
All website content, including text, graphics, logos, and design, is owned by EPST unless otherwise stated. You may not reproduce or distribute it without written permission.

Third-Party Links
Our website may include links to third-party sites. EPST does not endorse or control those sites and is not responsible for their privacy or security practices.

Limitation of Liability
